Default Republican River water

Reading a post about the lowering of Red Willow got me thinking about the lawsuit that Kansas filed on Nebraska. Does the amount of water that Nebraska has to deliver to Kansas have to come at certain times of the year or just so much total per year? If they are releasing a bunch of water from Red Willow and Harlan is almost at pool right now, and with the rest of the winter and spring to go, will we get credit for sending Kansas water right now?

A guy that does some work for us has a son that works for the for the Cor down at Harlan. I got the feeling that when the lake was full this spring, we were trying to drown them in Kansas. Wink, Wink. When the lake is full and Kansas has been complaining about water for 20 years, you do what you have to do.

This brings up another good point, do we get credit for any additional outflow to Kansas?

First of all, thank you Chen for bring this topic up!

After talking with the General Manager, Mike Clements with the Lower Republican NRD in Alma, I received the following information. I don't know shorthand, but I am confident my "scribbles" are 100% accurate!

The releases are part of a "consumptive use" compact. Meaning how much is used from the AVAILABLE SUPPLY. If 10 gallons of water come into NE on the Republican River Basin, NE "owes" KS a percentage of that water.

Water is provided when a call comes from NE/KS irrigation districts.

Because it is based on how much water comes INTO NE, TIME of the year is NOT a factor.

Mr. Clements mentioned that in the early spring of this year, when Harlan was at Flood Pool, water was released. Even though there was no request from Irrigation Districts. YES, this water COUNTS.

Frankly, I'm not sure where water released from Harlan would go. Milford is about as full as they will let get right now and as wet as it has been downriver this year, they haven't been releasing much. Once they do open the gates, I will be there looking for some 'eyes, though.

They started to let out water from Harlan.
